Agreement

These Terms and Conditions ("Terms") govern your access to and use of the SuperData website, application, and related services (collectively, the "Service") operated by SuperData ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Accounts

  • You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
  • You must notify us promptly if you believe your account has been accessed without authorization.
  • We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users.

Subscriptions and billing

  • Paid plans, free trials, and promotional pricing are described on our pricing page and at checkout.
  • Subscriptions renew automatically unless canceled before the renewal date.
  • Payments are processed by our third-party payment provider. By subscribing, you authorize us and our payment provider to charge applicable fees.
  • Fees are generally non-refundable except where required by law or explicitly stated otherwise.
  • We may change pricing or plan features with reasonable notice. Price changes apply to future billing periods unless otherwise stated.

Acceptable use

You agree not to misuse the Service. This includes, without limitation:
  • Violating applicable laws or third-party rights.
  • Attempting to gain unauthorized access to the Service, other accounts, or our systems.
  • Uploading malware, spam, or harmful code.
  • Reverse engineering, scraping, or reselling the Service except as permitted by law.
  • Using the Service to generate unlawful, deceptive, or abusive content.
  • Interfering with the normal operation, security, or performance of the Service.

Your content

You retain ownership of the information, prompts, product details, and other content you submit to the Service ("User Content"). You grant us a limited license to host, process, and use User Content solely to operate, maintain, and improve the Service, including generating plans, tasks, and AI-assisted outputs for your workspace.

AI-generated output

The Service may generate marketing plans, tasks, recommendations, and other outputs using automated systems. AI output may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing output before relying on it and for how you use it in your business, marketing, or communications.

Intellectual property

The Service, including its software, branding, design, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as needed to use the Service.

Third-party services

The Service may integrate with or link to third-party tools such as payment processors, analytics providers, authentication services, and AI providers. Your use of those services may be subject to their separate terms and policies.

Availability and changes

We strive to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, including features, plans, or availability in specific regions.

Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim or one hundred U.S. dollars (USD $100).

Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe continued access would harm the Service or others. Upon termination, your right to use the Service ends, but sections that by their nature should survive will continue to apply.

Governing law

These Terms are governed by the laws applicable in our place of business, without regard to conflict-of-law principles, except where mandatory local consumer protections apply.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date below. If changes are material, we may provide additional notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
